農(nóng)村集體土地房地產(chǎn)征收補償法律問題研究

摘要:農(nóng)民問題的核心是土地問題。現(xiàn)階段中國法律法規(guī)體系在具體法律關(guān)系界定上,尚存在農(nóng)村土地所有權(quán)、使用權(quán)與集體土地所有權(quán)、使用權(quán)權(quán)利與義務(wù)不對等,存在所有權(quán)和使用權(quán)歧視,農(nóng)村集體土地征收補償規(guī)定不符合市場經(jīng)濟規(guī)律等諸多急需完善的地方,從而對征地工作和土地征收補償評估帶來了相當大的困難,也造成了房地產(chǎn)估價人員對被征收土地征收補償價格構(gòu)成理解上的偏差和評估方法選定的單一。因此,在具體中,必須用城鄉(xiāng)統(tǒng)籌的觀念進行土地管理立法,明確農(nóng)村集體土地所有權(quán)權(quán)利主體,對土地使用權(quán)進行統(tǒng)一界定,建立市場化的農(nóng)地征收制度。

The Study on the Expropriation and Compensates Appraisal of the Real Estate of Rural Collective and Its Legal Problem

Abstract: The core of peasant’s question is a land question. At the present stage, the defining on the concrete legal relation in China’s laws and regulations system still exist inequity in rural land ownership, usufruct, collective land ownership, right and obligation of land use. Ownership and right to use exists discrimination. The regulation of compensates of the rural collective land is not accord with the economic law of the market etc, which has many problem need badly to consummate. Accordingly, work taking over the land for use and land use compensates appraisal is sizable difficulty. It is also work the understand deviation between appraisers and the appraisal method selection singularity. Therefore, we must carry on land management and legislate with the idea of the urban and rural areas in concrete, definitude the subject of right of rural collective land ownership, define in unison of the right to use the land and set up market-based farmland and take over the system for use.

土地征收、房屋拆遷是在城市建設(shè)過程中不可逾越的步驟,是一項涉及面廣、政策性強,關(guān)系到廣大人民群眾切身利益,關(guān)系到全社會穩(wěn)定的大事。這項工作的成敗,關(guān)系到各級政府能否真正貫徹實踐“三個代表”重要思想,“執(zhí)政為民”的大事。隨著我國國民經(jīng)濟的持續(xù)快速發(fā)展,城市建設(shè)進程迅速加快,城鄉(xiāng)面貌發(fā)生了顯著的變化。但是,在城市建設(shè)中,由于現(xiàn)行的有關(guān)法律法規(guī)尚不完善,征地、拆遷等領(lǐng)域諸多問題迅速暴露出來,以征地、房屋拆遷和居民安置為中心的拆遷沖突,已直追農(nóng)民負擔、下崗失業(yè)問題,成為近年來群眾上訪的又一大焦點。補償標準普遍偏低,土地使用權(quán)人、房屋所有權(quán)人的權(quán)利被漠視,是當前征
